1. Terms of Service1.1 OverviewSTUDIO by PrintStick (“the Service”) is a subscription-based collection of browser-based design tools (“Tools”) operated by PrintStick (“we,” “us,” or “our”). By accessing or using any of the Tools provided through the Service, you (“the User”) agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.1.2 Description of the ServiceSTUDIO by PrintStick provides subscribers with access to a suite of browser-based creative design tools. These Tools are intended to help users quickly create digital design elements such as digital stickers, collage boards, covers, wallpapers, digital notebooks, gradients, and other digital assets (“Digital Downloads”) strictly for personal use.We reserve the right to add, modify, or discontinue any Tool within the Service at any time without prior notice.1.3 Subscription; AccessAccess to STUDIO by PrintStick requires an active paid subscription. By subscribing, you acknowledge and agree that:• Your subscription grants you a personal, non-exclusive, non-transferable, revocable license to use the Tools for the duration of your subscription period.
• You may not share, resell, sublicense, or distribute your access credentials to any third party.
• We reserve the right to terminate or suspend your access at any time if we determine that you have violated these Terms.
• Subscription fees, billing cycles, and cancellation policies are governed by the terms outlined on our subscription page at the time of purchase.1.3.1 Internet Connection & Account Login RequirementSTUDIO by PrintStick is a browser-based service that requires an active internet connection and a valid logged-in account on PrintStick.shop to access and use the Tools. You acknowledge that the Tools are not available offline and cannot be accessed without maintaining an active internet connection and authenticated session. PrintStick is not responsible for any inability to access the Service due to connectivity issues, network interruptions, or account access problems.
1.3.21.3.2 Refund Policy; No Refunds;Due to the digital nature of STUDIO by PrintStick and the immediate access granted to all Tools upon successful payment, all subscription fees and payments are non-refundable.By purchasing a subscription, you acknowledge and agree that access to the Service begins immediately after payment is processed. As a result, you waive any right to request a refund, chargeback, or partial refund for any reason, including but not limited to unused time, unused features, lack of usage, or dissatisfaction with the Service.Any content, designs, or digital assets created using the Tools are considered digital goods that cannot be returned.You may cancel your subscription at any time to prevent future billing. Upon cancellation, you will retain access to the Service until the end of your current billing period, after which access will terminate.
1.4 Nature of the ToolsThe Tools provided through STUDIO by PrintStick are browser-based creative utilities. They are provided “as is” and “as available.” By using the Tools, you understand and agree that:• The Tools are designed to assist you in creating digital design elements quickly. The suitability of any output depends on your inputs and creative decisions.
• PrintStick does not guarantee uninterrupted, error-free, or secure operation of any Tool. Browser compatibility, device capabilities, and operating system updates may affect functionality.
• You are solely responsible for evaluating the suitability of any files or outputs generated through the Tools before using them for any purpose.1.5 User Responsibilities; Acceptable UseAs a user of STUDIO by PrintStick, you agree to the following:• You will use the Tools only for lawful purposes and in compliance with all applicable local, state, national, and international laws and regulations.
• You will not use the Tools to create, distribute, or promote content that is defamatory, obscene, harmful, infringing, or otherwise objectionable.
• You are solely responsible for ensuring that any images, fonts, or other media you upload to the Tools do not violate any third-party intellectual property rights, copyrights, trademarks, or licenses.
• You will not attempt to reverse-engineer, decompile, modify, or create derivative works of the Tools or their underlying code.
• You will not attempt to circumvent any access restrictions, security measures, or usage limitations implemented in the Service.2. Disclaimer of Warranties; Limitation of Liability2.1 Disclaimer of WarrantiesTHE TOOLS AND SERVICE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. PRINTSTICK DOES NOT WARRANT THAT THE TOOLS WILL MEET YOUR REQUIREMENTS, OPERATE WITHOUT INTERRUPTION, OR BE FREE OF ERRORS, OR DEFECTS.2.2 Limitation of LiabilityTO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PRINTSTICK AND ITS OWNERS, EMPLOYEES, AFFILIATES, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE TOOLS OR THE SERVICE, EVEN IF PRINTSTICK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL PRINTSTICK’S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR YOUR SUBSCRIPTION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.2.3 Assumption of RiskYou acknowledge that the use of any browser-based design tool involves inherent limitations, including but not limited to potential data loss, rendering inconsistencies, and browser-specific behaviors. By using the Tools, you voluntarily assume all risks associated with such use. PrintStick strongly recommends saving your work frequently and maintaining your own backups of any important files or designs.3. Data & Privacy Policy3.1 No Server-Side StoragePrintStick does not have the capacity or infrastructure to store any files you upload to or create within the Tools. All processing occurs locally within your web browser. Any images, fonts, design files, or other media you upload or generate are processed entirely on your device and are never transmitted to or stored on PrintStick’s servers.3.2 Local Storage & Browser DataSome Tools may use your browser’s local storage, session storage, or cache to temporarily hold design settings, preferences, or in-progress work. You should be aware that:• This data is stored locally on your device and is not accessible to PrintStick.
• Clearing your browser cache, cookies, or data may result in the loss of any unsaved preferences or in-progress work.
• PrintStick is not responsible for any data loss resulting from browser actions, device malfunctions, or software updates.3.3 What We Do CollectWhile we do not collect or store your uploaded content, our website and subscription platform may collect standard information such as:• Account and subscription information (name, email, payment details) processed through our e-commerce platform.
• Standard analytics data such as page views, browser type, device type, and general usage patterns to help us improve the Service.
• Cookies necessary for authentication, session management, and site functionality.For details on how our e-commerce platform handles your data, please refer to our main website’s Privacy Policy and Shopify’s privacy practices.3.4 Your Responsibility for Your ContentSince all files remain on your device, you are solely responsible for backing up, securing, and managing any designs, images, or files you create using the Tools. PrintStick cannot recover, retrieve, or restore any content that you lose.4. Intellectual Property4.1 Ownership of the ToolsAll Tools, including their code, design, user interface, graphics, and underlying technology, are the exclusive property of PrintStick and are protected by applicable intellectual property laws. Your subscription grants you a limited license to use the Tools; it does not transfer any ownership or intellectual property rights to you.4.2 Third-Party ContentYou are solely responsible for ensuring that any third-party content you upload or use within the Tools (including but not limited to images, photographs, fonts, logos, and graphics) is properly licensed for your intended use. PrintStick does not verify, endorse, or assume liability for any third-party content used within the Tools.5. General Provisions5.1 Changes to These PoliciesPrintStick reserves the right to update or modify these policies at any time. Continued use of the Service after any changes constitutes your acceptance of the revised terms.
